Special terms for online workshop booking and shipping

This English version is provided for your convenience. In case of doubt, the German version applies (Es gilt die deutsche Fassung).

These terms apply to contracts concluded by consumers (§ 13 BGB, German Civil Code) via our website linnepe.eu: the online workshop booking (parts with fitting in our workshop in Ennepetal or at our Servicecenter Süd in Burgheim) and the mail-order purchase (parts for self-fitting). Our General Terms and Conditions apply to dealers and other traders. Unless these Special Terms provide otherwise, the General Terms and Conditions also apply to consumers, with the exception of the provisions on advance payment ex works, non-binding dates, place of jurisdiction and the shortening of the warranty period.

1. Contracting party

2. Online workshop booking: conclusion of the contract

2.1 The product finder and the shopping basket show you a package consisting of parts, fitting and, where required by law, TÜV inspection, together with the total price. By clicking on “Book with obligation to pay”, you submit a binding offer to conclude a contract for the supply and fitting of the parts named in the package on the stated date.

2.2 The contract is concluded when we confirm your booking by e-mail (booking confirmation with booking number). We send this e-mail immediately after your booking.

2.3 You enter the details of your vehicle (manufacturer, model, year of manufacture, chassis) in the product finder. If your vehicle deviates from these details when it is accepted and the booked parts therefore do not fit, we will agree the way forward and any additional charge with you before we begin the fitting. In this case you may cancel the contract free of charge.

3. Prices and payment for the workshop booking

3.1 All prices are final prices in euros including statutory value added tax. The total price covers the parts, the fitting at a fixed price and, where shown in the package, the inspection by the testing organisation including the registration entry. No shipping costs are charged for the workshop booking.

3.2 You pay on site after the fitting, when collecting the vehicle. We accept payment by debit card (EC card) or credit card and in cash. No deposit is required.

3.3 Additional work that becomes necessary during the fitting (for example because of existing attachments from other manufacturers) will only be carried out with your consent and will be invoiced separately according to the work involved.

4. Appointment, vehicle drop-off, cancellation

4.1 The appointment is binding. You drop off the vehicle on the booked day at 8 a.m. and collect it on the same day by 4 p.m., on Fridays by 1 p.m. On request and subject to availability, we provide a courtesy car free of charge for the workshop day (to be returned with a full tank; driver at least 21 years of age with a valid driving licence) or a guest cabin on our premises; you make your choice when booking.

4.2 You may postpone or cancel the appointment free of charge up to two working days before the booked day, by e-mail to kontakt@linnepe.eu or by telephone. In the event of a later cancellation or failure to attend without cancelling, we may charge you for the parts already ordered for you that cannot be used otherwise, together with a flat-rate expense charge of 50 euros; you remain free to prove that the loss incurred was lower.

4.3 Your statutory right of withdrawal remains unaffected (see Cancellation policy).

4.4 If we have to postpone the appointment, we will inform you without delay and offer you an alternative date. If no alternative date suits you, you may withdraw from the contract.

5. Weight upgrade and inspection

5.1 For packages including a weight upgrade (Auflastung, increase of the permissible gross weight), inspection by a testing organisation (TÜV, DEKRA or comparable) with an entry in the registration certificate is required by law. For the workshop booking, we take care of the inspection and registration entry on the day of fitting; the price is shown in the package. This requires a wheel and tyre combination with sufficient load capacity and a vehicle registered in Germany.

5.2 For parts for self-fitting (mail-order purchase), you must arrange the inspection yourself with a testing organisation of your choice. The expert report is enclosed with the auxiliary air suspension. On request, we take care of the inspection and registration entry; this requires a workshop appointment with us.

6. Mail-order purchase: conclusion of the contract, prices, delivery

6.1 By clicking on “Order with obligation to pay”, you submit a binding offer to purchase the parts listed in the shopping basket. We confirm receipt of your order immediately by e-mail; this acknowledgement of receipt does not yet constitute acceptance. The contract of sale is concluded when we send you the order confirmation with the shipping costs and our bank details by e-mail, and at the latest when the goods are dispatched.

6.2 Prices are final prices in euros including value added tax. Shipping costs are charged in addition. They depend on the weight and bulkiness of the parts (parcel or freight forwarder) and will be communicated to you in the order confirmation before you make payment. If you do not agree with the shipping costs, you may cancel the order free of charge at any time before payment.

6.3 Payment is made in advance to the account stated in the order confirmation. We dispatch after receipt of payment, at the earliest two weeks after the order; we will inform you of the dispatch date by e-mail. We deliver within Germany.

6.4 We supply hydraulic levelling jack systems to consumers only with fitting in our workshop. A weight upgrade is not shipped (see section 5).

6.5 The goods remain our property until payment has been made in full.

7. Warranty and liability

7.1 The statutory warranty rights apply. The limitation period for claims for defects is two years from handover or acceptance for new parts and for our fitting services.

7.2 We are liable without limitation for damage resulting from injury to life, body or health and for intent and gross negligence. In the event of a slightly negligent breach of material contractual obligations, our liability is limited to the foreseeable damage typical for this type of contract. Claims under the Product Liability Act (Produkthaftungsgesetz) remain unaffected.

7.3 Information on weight upgrade levels, axle loads and fit is based on the data of the vehicle manufacturers and our vehicle database. The details in your vehicle documents and the examination of the vehicle are decisive.

8. Dispute resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

9. Final provisions

The law of the Federal Republic of Germany applies. In relation to consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has his or her habitual residence. The language of the contract is German. We store the text of the contract; you receive the booking or order details with our confirmation e-mail. You may access and print these terms on this page at any time.
